Virtual Mediation Lab Presented at 2012 Hawaii Peer Mediation Conference

The Statewide Peer Mediation Conference – Celebrating 20 Years of Mediation in the Schools will be held Friday, February 24, 2012 at the University of Hawaii Manoa Campus Center.

It looks like we will be able to present Virtual Mediation Lab, a pilot project sponsored by the Association for Conflict Resolution – Hawaii Chapter. We will show how online mediation simulations via Skype can help peer mediators to:

Practice and improve the mediation skills they learned during their training
Be prepared for the toughest cases they may come across in real situations

In addition, we will also show how an entire group/classroom can observe an online peer mediation simulation for later discussion with their trainer.

Due mesi fa l’Association for Conflict Resolution – Hawaii Chapter, di cui faccio parte e sono stato Presidente, ha lanciato un nuovo progetto – Virtual Mediation Lab (Laboratorio Virtuale di Mediazione) – che potrebbe essere molto utile anche in Italia.

Di Cosa Si Tratta
In breve, mediatori civili con o senza esperienza partecipano a simulazioni online di mediazione con Skype, allo scopo di perfezionare e far pratica con le tecniche gia’ apprese durante i loro corsi di mediazione. Questo video spiega in maggior dettaglio e dimostra in 3 minuti come funzionano le simulazioni.

Requisiti
I requisiti per partecipare a questo progetto sono semplicemente:

Aver gia’ partecipato ad un corso base o avanzato di mediazione civile
Un PC o Mac dotato di Skype con webcam, microfono e altoparlanti
Un collegamento Internet veloce

Partecipazione
La partecipazione a questo progetto e’ gratuita fino al suo completamento (vedi sotto) ed e’ limitata a 10 mediatori Americani e 10 mediatori Italiani.

Che Tipo di Controversie Vengono Simulate
I mediatori Americani propongono e simulano la mediazione di casi relativamente semplici e tipicamente Americani. Analogamente, i mediatori Italiani propongono e simulano la mediazione di casi relativamente semplici e tipicamente Italiani.

Conclusione del Progetto e Presentazione dei Risultati
Dopo un significativo numero totale di simulazioni online di mediazione, realizzate negli USA o in Italia, il progetto Virtual Mediation Lab verra’ considerato concluso.

Ad esso seguira’ un workshop, organizzato dall’Association for Conflict Resolution – Hawaii Chapter, per presentare i risultati del progetto e discutere i seguenti punti:

Cosa abbiamo imparato – Reazioni, commenti e suggerimenti dei mediatori/partecipanti

Session I: 9:00am to 10:15am
Title: Mediating Personal Injury Cases
Program Description: Injury litigation not only presents a unique set of substantive issues but is furthermore complicated by the fact that typically it is a third party paying for the resolution. There is as well as significant conflict of interest problem for the mediator in these cases that we will explore during this presentation.

Session II: 9:00am to 10:15am
Title: Mediating Health Care Issues with Physicians, Hospitals, and Insurance Companies
Program Description: Disputes arising in the health care field present unique challenges and opportunities. Some of the opportunities arise out of the fact that health care payors and providers need to maintain productive relationships with each other, in order to remain viable: hospitals do not do well without physicians, and vice versa, and payors need providers, and vice versa. As a result, disputants are motivated to seek creative solutions to preserve and enhance their relationships. Challenges arise from the complex regulatory scheme that governs virtually every aspect of health care. As a result of the regulatory scheme, solutions that make perfect sense from a business standpoint could expose the disputants to possible administrative, civil and even criminal liability. This program will discuss the relationship opportunities and regulatory constraints that characterize the resolution of disputes in health care.

Title: Trends in Employment Mediation and Conflict Resolution
Program Description: The mediation of employment disputes continues to be widely accepted, but has some recent innovations and trends. This presentation will focus on three themes: a profile of disputes being mediated, “tips’ and techniques in mediating employment disputes, and workplace conflict systems. Our discussion will be highly interactive with plenty of time for questions.

Title: Facilitating Large Community Disputes
Program Description: This program will focus on the challenges which are involved in mediating large complex disputes, particularly multiparty disputes occurring in the public sector. Title: Mediating Environment Law Cases
Program Description: Environmental disputes may be the most complex of the complex. The combination of regulatory, technical and economic issues, coupled with the intricate undercurrent of multiparty relationships, can render the uninitiated neutral ineffective and whimpering in the corner. The Presenter will take you through the “Whack-A-Mole World” of environmental ADR, identify the thorny impediments to settlement, and provide solutions and tools to help lead a dispute to resolution. This presentation will be in great interest to environmental, construction, real estate, and governmental professionals.
Presenter: Robert F. Copple, Ph.D., J.D., is a well known environmental neutral, advocate, writer and speaker.

Session VII: 2:30PM to 3:45PM
Title: Mediating Using Video Conferencing Technology
Program Description: On a global scale, Practitioners in the arena of Mediating are incorporating a new aspect in how they service their clients. This service of change is infusing the Technology of Video Conferencing into their practices. Presentations and discussions will include present and future Video Conferencing practices, review solutions on how to best utilize Video Conferencing and knowing the associated pro’s and con’s.

Title: Mediating Elder Law Cases : For Baby Boomers and their Parents–Issues of Aging Are Here to Stay: Are We All Ready?

Gain an understanding of the difficult issues and predicaments central to the conflicts arising in the aging population.
